HOA formation, governance, and assessment issues under Utah law for both condominium associations and community associations are discussed. The impact and enforcement of covenants, conditions, and restrictions are addressed. Special emphasis is placed on the Utah REPC change of ownership fees section and HOA-related disclosure issues. HOA liens and corresponding collection and foreclosure processes are reviewed and discussed. Examples of HOA-related obstacles to real estate closings are shared and discussed throughout the course.
